Terms of Service

These Terms of Service ("Terms") govern access to and use of Pharmacy Digital, a website building and hosting platform for pharmacies, operated by YEG Digital ("Pharmacy Digital," "we," "us," or "our"). By creating an account, publishing a site, or otherwise using the service, you agree to these Terms. If you do not agree, do not use the service.
1. What Pharmacy Digital is
Pharmacy Digital is a platform for building and hosting pharmacy websites. It includes a page builder, brand and design tools, a blog, a contact and lead capture system, business information and hours management, team access controls, and integrations with third-party services such as Google Analytics. A site built on the platform is created as a draft, reviewable before it goes live, and is only published to its public web address once a paid subscription is active.
The platform is organized into three levels of access: individual pharmacy accounts that manage a single site, banner or partner accounts that oversee multiple pharmacy sites under a shared brand, and platform staff who operate Pharmacy Digital itself. Each level has different permissions, described further in Section 4.
2. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to create an account. You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity that happens under your account. Tell us right away if you believe your account has been accessed without authorization.
Accounts are created either directly, by starting the onboarding process yourself, or by invitation from a banner or partner account. Accepting an invitation to manage a site or a banner is subject to these same Terms.
3. Subscriptions and billing
Publishing a site to its live web address requires an active paid subscription. Subscriptions are billed monthly in advance and processed by Stripe, our payment processor. We do not store your full payment card details ourselves. Pricing for the currently available plan is shown on our pricing page at the time of signup; additional plans may become available over time, with different features included at each level.
Subscriptions renew automatically each billing period until cancelled. You can cancel at any time through your account's billing settings, which are managed through a Stripe-hosted customer portal. If a payment fails or a subscription is cancelled, your site's public page may be taken offline or suspended while it remains accessible in draft form for you to review and reactivate.
Fees are non-refundable except where required by law or expressly stated otherwise. We may change pricing for future billing periods with reasonable advance notice.
4. Banner, partner, and staff accounts
A banner or partner account may be granted access to manage multiple pharmacy sites under a shared brand, including their content, staff invitations, and support requests submitted by those sites. If your site was set up under a banner or partner, that banner or partner may have visibility into your site's content and business information as part of providing that shared brand experience, and support requests you submit are routed to them rather than directly to Pharmacy Digital staff.
Platform staff accounts have administrative access across the platform for the purpose of operating, maintaining, and supporting the service, and to enforce these Terms.
5. Your content
You retain ownership of the content you create or upload through the platform: text, images, business information, blog posts, team profiles, and anything else you add to your site. By uploading or entering content, you grant Pharmacy Digital a license to host, store, process, display, and transmit that content as needed to operate and provide the service, including on your site's public web address once published.
You are solely responsible for your content and for making sure it is accurate, lawful, and that you have the rights to use it, including any images, logos, or third-party material you upload. Pharmacy Digital does not review content for medical, regulatory, or professional accuracy before it is published, and publishing a site does not constitute an endorsement of its claims.
6. Acceptable use
You agree not to use the platform to:
- Publish content that is unlawful, fraudulent, deceptive, or that misrepresents your credentials, licensing, or scope of practice as a pharmacy;
- Publish medical or health claims that are false, misleading, or that you are not legally authorized to make;
- Infringe on another party's intellectual property, privacy, or other legal rights;
- Use the built-in contact and lead capture forms, or any embedded newsletter signup, to collect information for purposes other than responding to genuine inquiries from your own site's visitors;
- Attempt to interfere with, disrupt, or gain unauthorized access to the platform, other accounts, or other sites hosted on it;
- Use the platform to send unsolicited bulk communications or otherwise abuse its email or messaging features.
We may suspend or terminate access for accounts that violate this section, with or without notice depending on severity.
7. Third-party services
The platform relies on third-party providers to operate, including Stripe for payment processing, Mailgun for email delivery, and infrastructure providers for hosting, database, and domain services. Optional integrations, such as Google Analytics, Google Tag Manager, and Google Search Console, are configured at your own discretion and are governed by those providers' own terms. A site may also embed third-party content you choose to add, such as a YouTube or Vimeo video or a Google Maps link. We are not responsible for the availability, content, or practices of third-party services.
8. Service availability and changes
We aim to keep the platform available and reliable but do not guarantee uninterrupted access. The service may be unavailable at times for maintenance, updates, or reasons outside our control. We may add, change, or remove features over time as the platform develops.
9. Termination
You may stop using the platform and cancel your subscription at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if your subscription lapses and is not reactivated within a reasonable period. Upon termination, your site's public page will no longer be accessible; we may retain your account data for a limited period afterward as described in our Privacy Policy before it is deleted.
10. Disclaimers
The platform is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be error-free, secure, or uninterrupted, or that any defects will be corrected.
11. Limitation of liability
To the fullest extent permitted by law, Pharmacy Digital and YEG Digital will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising from your use of the platform. Our total liability for any claim arising from these Terms or the service will not exceed the amount you paid us in the three months before the claim arose.
12. Indemnification
You agree to indemnify and hold Pharmacy Digital and YEG Digital harmless from any claims, damages, or expenses, including reasonable legal fees, arising from your content, your use of the platform, or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict of law principles.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the date at the top of this page and, where appropriate, notify account holders directly. Continued use of the platform after changes take effect means you accept the updated Terms.
